Acceptance of Terms:
Signing up for a user login name and password, enabling you to play trivia games, implies that you are in agreement with our Terms of Service in the most recent format we have. These Terms of Service are binding. It is the users’ sole responsibility to frequently familiarize themselves with any changes whereas the most current form of the Terms of Service will apply.
Right to change:
Play All Trivia may modify these Terms of Service at any time and depending on the nature of the change we will provide notice to you. Your continued subscription to the Service shall be deemed your acceptance to these Terms of Service, as they may be modified.
Player Eligibility:
To play any game and open an account with Play All Trivia a user must:
Be the person that is the owner of the email address given at the time of registration and be at least 13 years of age. Players must be a valid United States resident to claim a prize.
If a user is a U.S. citizen or physically located in the U.S. they must be in a State where the law does not prohibit them from participating in games provided at any Play All Trivia or partner website.
Play All Trivia reserves the right to monitor a participant’s location and to require proof of valid U.S. residency before issuing a prize.

User Accounts and Limitations to playing our trivia games:
Each user can have only one user account. There can be a maximum of two users per household. Each household is limited to one attempted play per trivia game. For the purposes of drawing a winner, a maximum of three first place tournaments can be used. Users must be at least 18 years of age, and in some localities 21, to participate in the drawing(s) for prize(s).
User Conduct:
Users must adhere the Rules. No cheating of any kind will be tolerated. Cheaters are subject to the full extent of the law. Users must also observe non-offensive language both in common chat or forum area as well as in the selection of usernames. Play All Trivia reserves the right to disable, ban or disqualify users who select inappropriate or offensive usernames at our sole discretion.
Game Winners:
Play All Trivia declares the winners in each tournament based on internal information and is obligated in no way to change these decisions or to justify our final decisions regarding winners and the awarding of prizes.
Play All Trivia reserves the privilege of displaying usernames and scores on our scoreboards as stated in the Privacy Policy.
Disabling of User Accounts
If a user who does not meet our eligibility signs-up for an account, we reserve the right to disable the account upon notice of said ineligibility and any prize that user was eligible for will be revoked and not awarded. The user, if the prize has been awarded, will be liable to any and all damages and legal fees that arise from a claim.
Play All Trivia reserves the right to disable your login name if it is offensive, if a user engages in any questionable behavior, or for any other reason that we may deem necessary. Play All Trivia is in no way obligated to inform the user as to why their account has been disabled nor obligated to reinstate the user.
Technical Configuration:
This program requires a Windows PC Operating System (98, ME, 2000, XP, Vista), a Pentium or Athalon processor (or better), Internet Explorer (version 5 or 6), DirectX Software (version 8 or higher), and a Video Card (some games require 3D graphics capability).
A cookie is data stored on a customer's computer by a web browser. Cookies contain information that supports the behavior and functionality of our website. Our website may use both session cookies and persistent cookies. These cookies do not contain personally identifiable information. A user can control the setting of their cookies on their web browser. Cookies must be enabled in order to play a Play All Trivia game.
Active-X:
Active-X programs are executable programs transferred to your computer's hard drive that cause your computer to perform functions in connection with your visit to a website. Play All Trivia uses Active-X technology to make your gaming experience as streamlined and user friendly as possible and to prevent cheating. We also use Active-X programs to transfer files allowing you to play our games to your computer’s hard drive. We use this Active-X control to preserve the sanctity of the game with propriety information to ensure that players will not participate in fraudulent or deceptive actions in regard to the games. When you are ready to play a game, and do not already have it installed the Active-X control will update your system automatically. Our Active-X program is a safe application and contains no spyware. You can uninstall our console through the "Add or Remove Programs" on the Control Panel at any time.

All contents of this site are owned solely by ZOI Interactive Technologies, Inc., sole owner of the Play All Trivia product. All programs, logos, artwork, trademarks, patents, intellectual property, and licenses represented on our site may not be used, sold, published, modified, tampered, hacked, or exploited for any reason without ZOI giving explicit written permission prior to its use. All questions and content are solely owned and copyrighted by Play All Trivia.com, a ZOI product.
Governing Law and Disputes:
These Terms of Service are written and substantiated in regard to the laws of the State of Tennessee. By participating in online activity at Play All Trivia the user agrees that any disputes that are unresolved will be settled in accordance to the laws of the State of Tennessee.
Independence of sections:
If there is any part of these Terms of Service that are not enforceable by law or are voided the rest of the Terms of Service which are still enforceable and valid will remain.
Legality and Taxes:
The user takes full responsibility for meeting all the laws and regulations of the State, Province, or country of residence in regards to the taxes associated with and legality of accepting cash or other prizes. ZOI cannot be held liable for any activity, actions, or decisions that are a result of any governing law related to the disposal and distribution of any prize awarded through Play All Trivia.com or any related party.
No Warranties:
Play All Trivia assumes neither responsibility nor liability for damage to or malfunction of a user’s computers or hard drives. Play All Trivia is not responsible for any damage, loss, or injury resulting from tampering or hacking of our servers by unauthorized users.
Play All Trivia does not guarantee that any prize we claim to offer will be exactly as described. We withhold the option of issuing prizes of equal value to those described but cannot guarantee that they will fit the original prize description.
Play All Trivia will send prizes via a registered mail carrier such as the USPS, FedEx, or such. We claim no responsibility for any damage or loss inflicted by that carrier. The products issued as prizes are covered by the manufacturers of that prize’s own terms, conditions, and warranty.
All disputes will be settled by Play All Trivia at our discretion.
Your privacy is important to us and we understand that it is your choice to provide us with personal information and we respect that choice. By visiting and taking part in the games or any other activity at Play All Trivia the website or on our spyware and adware free console, you are agreeing to the terms established in our Terms of Service.
What information do we collect from you and why?
In order to play one of our trivia games, you must first give us a valid email address, a chosen username and a user-created password. This information is used to contact you in the event you have won a prize or for other important site-related matters. You are always free to opt out of all communication via email, but this will disqualify you from winning prizes.
We also may request demographic information (age, gender). We use this information to improve the quality of the games that we provide on our site and we do appreciate if you share your information with us.
We are required to ask you your age to verify that you are over the age of thirteen in adherence with the Childrens Online Privacy Protection Act of 1998 ("COPPA"). We do not allow children under the age of 13 to play in any of our games and therefor do not collect personal information from any person under the age of 13. If it is found that a person under the age of 13 participated in a game on Play All Trivia we will promptly fix the situation by disabling their account and deleting all of their personally-identifiable stored information.
How do we collect your Personal Information?
Play All Trivia tracks anonymized traffic throughout our site and console using cookies and/or ActiveX. This information is used to compile overall statistics. The information we track includes IP (internet protocol) addresses, browser type, ISP (internet service provider), referring/exit pages, platform type and timestamp. We use this information to improve our site and better serve you. None of the information directly identifies you. It is standard information generated by your usage of our site and console.
Play All Trivia uses aggregate information to customize and improve our website. The general demographic and other market information does not personally identify you to any person. Aggregate information is occasionally shared with partners of Play All Trivia to plan advertisings and promotions. We will not share any personally identifiable information.
What do we do with the information you provide?
Play All Trivia, a ZOI Interactive Technologies, Inc. product, is the sole owner of the information collected on our website. Play All Trivia will not sell, share, or disclose this information to third parties in ways not disclosed in this statement. Play All Trivia collects information from our users at several different points on our website. The only time we will disclose personal information is when required to by law or with the good-faith belief that such action is necessary in order to conform to the law.
By registering for an account, you agree that Play All Trivia may display your username and tournament records in our scoreboards.
Surveys and Drawings
At times we may provide surveys and drawing that require personal information. Participation in these surveys and drawing is completely voluntary. Information requested may include contact information (such as name, shipping address and email address), and demographic information (such as zip code and age). Contact information will be used to notify the winners and award prizes. Survey information will be used to monitor and improve our services.
Refer (Challenge) a Friend
When a user elects to use our referral service to inform a friend about a trivia game, the user is required to provide Play All Trivia with the friend's name and email address. Play All Trivia will then automatically send the friend a one-time email inviting them to visit the site. Play All Trivia will not permanently store your friend's email address.
Updating Our Policies
Play All Trivia retains the right to change our Terms of Service at any time. It is the users’ responsibility to review our policies as frequently as they see fit in order to review any changes.
Legal Disclaimer of Responsibility of Responsibility
All content included in trivia questions and on Play All Trivia is for entertainment purposes only. Play All Trivia does not claim to be experts in any of the categories for which we write trivia questions. Play All Trivia is in no way associated with any organization, person, team, movie, game, company, band or subject matter related to the trivia questions we provide in our games. We disclaim all responsibility for misuse of our site or any damage that may come to your system as a result of using Play All Trivia.
The only time Play All Trivia will disclose personal information to a third party is when required to do so by law or with the good-faith belief that such action is necessary in order to conform to the law. Under no circumstances shall Play All Trivia be liable for any indirect, special, incidental or consequential damages of any kind, regardless of the form of action, whether in contract, tort (including negligence), strict product liability or otherwise, even if we have been advised of the possibility of such damages. Rules
Entries into Tournaments
Each trivia game may be entered only once per account and/or once per computer, which ever comes first. Once begun, games must be completed without interruption for a score to count. Interruptions caused by third-party programs, computer malfunction, inadvertent clicks, are the sole responsibility of the user.
Answering Questions
Inadvertent clicks are the sole responsibility of the user. If a game crashes during play, no matter the reason, Play All Trivia is not responsible and a player may be disqualified from the tournament. The score up to the point of crash or exit may still win the tournament and be entered into the pool for the drawing(s) at the sole discretion of Play All Trivia.
Scoring
Scores are based on speed and accuracy. For each question, a timer ticks down from 1000 and the seconds left after a user correctly answers the question are recorded as points. Points are accrued from the 10 questions for the particular game only and not across all tournaments.
Winning a Tournament
Each tournament lasts a maximum of 90 calendar days. Whoever is in first place at the close of a tournament is declared the winner of that tournament. In the case of a tie, all tied users will be declared equal winners.
Winning Prizes
All first place winners of closed tournaments will be entered into a pool of winners. A player may be entered a maximum of three times into the pool, regardless of number of wins. All extra tournaments beyond the first three for which a winner is entered into the pool are closed as far as the pool of winners is concerned, unless a tie exists, in which case additional players may still be added to the pool.
From this pool, a drawing will be held at the close of all tournaments for at least one iPod along with prizes solely determined by Play All Trivia. Users may email Play All Trivia to PAT@PlayAllTrivia.com to find out the exact prizes for current tournaments. The drawings are completely random and there is no advantage for getting a higher score.
A valid email address is required for a user to redeem a prize. Play All Trivia reserves the right to verify information provided during registration. Play All Trivia and the awarding of prizes in this manner must be legal in the winner’s location, defined as their registration and/or shipping address, for the awarding of a prize. A user may only win a single (one) prize per six calendar months from the date of the close of the tournament(s), regardless of what the prize is. Future tournaments won by this user during said six months will be closed as regards the pool for drawings.
If a prize winner is found to be invalid for any reason, Play All Trivia reserves the right to declare no winner for that prize or to hold another drawing to award the prize, solely at its desecration. It can take up to 90 days after a drawing for a winner to be notified and their prize awarded to them. Usually, however, winners are notified within 30 days.
